Big Apple Moments Essay Description John Marshalls Big Apple Moments is reflective of Marshalls ability to capture a busy New York City. There are various travel cards in the foreground as a narrow alley bears off to the right and a busy street to the left. There are skyscrapers depicted on both sides of the painting. A little off center to the right is a silhouette of a couple. Upper right two thirds of painting is a green park with trees and a wide open path. Upper left one third is blue sky over skyscrapers with some printing over laying the blue sky. All of these components come together in John Marshalls Big Apple Moments. Formal Analysis Marshall creates a collage of several images to depict New York City. He draws you through two different New Yorks – one distant and one up close. The up close is about two thirds of the right side of the painting. The distant New York takes one third of the left side of the painting. A darkened view on the right of the painting. This area is very gray and shadowed. More detail is seen in the buildings and sidewalks on the right side of the painting. At the top of the paintings right side is a green open park with a wide path and sun light. The view on the left is brighter – and the buildings are more distant. The buildings seem to be lit with a bright sun and a blue sky is seen at the top of the left scene. The center of the painting is the silhouette of people. At the forefront of the painting is a Metro card and a ticket stub. Marshall uses a lot of darkened colors and nothing is defined with clean sharp lines. Interpretation Big Apple Moments begins with the ticket stubs. On the right side is an up close look of the city. A narrow street, a detailed ticket stub, and a cluttered side walk – they all bring the visitor to a close encounter with the Big Apple. A long street with a closed in feeling. Yet at the end of the street – on the top part of the painting is the green open park for the travelers oasis on this journey through New York City. On the left side of the painting – the visitor is more distant from the city. The feeling on this side of the painting is the visitor is just passing through. The two billboards seen at the tops of two buildings state clearly â€Å"The Journey† and there is â€Å"Parking Available† if you want to stop. The silhouetted figures in the center could be any traveler in the Big Apple. These figures are also open to viewer interpretation. Is it two people – one looking at the left and one on the right? Each with their own agendas? Or is this a couple – man and woman – together just enjoying the city – whether it be passing through or to see the town up close and personal? Judgment John Marshall succeeded with this work – and this title. Big Apple Moments. He captures the activity of the city, the variance of the Big Apple. He does so with subtle clues as to what the city is like. The city is to any person who visits there – whatever they want it to be. Some go to pass through and see the post card sites. Some go for a personal encounter with the culture of the city. Marshall goes so far as to paint the white lines on the road – not as a straight dotted line – but in angling different directions. Some sharp left, some sharp right, some slightly point one way or another, yet none are straight. That is because the city is open to individual experiences. Does the visitor want to do this or do that? Does the visitor want to go this way – or go that way? No matter what the visitor decides – there is that calmness of New York City. Whether that calmness be found in a taxi ride down a wide avenue – or at a serene park at the end of a hectic visit through and up close view of the Big Apple. There is not right or wrong way to see it. You just have to feel it – so grab a Metro Card – and lets go.

A Critique of Thank You for Smoking? :: Critical Essays

A Critique of â€Å"Thank You for Smoking†¦?† Intro: The essay â€Å"Thank You for Smoking,† written by Peter Brimelow, is far from an influential essay on why people should smoke. Through this essay, Brimelow makes an effort to convince the audience smoking is actually beneficial to your health. I find it hard for people to write about what they think are the benefits of smoking when there are so many obvious reasons why you should not smoke. The main audience being targeted in this article is those who already smoke and those who are thinking about smoking. One thing mentioned in the article is the fact that smokers are usually lighter in weight. In my personal opinion, I would rather eat a balanced diet and walk daily rather than walk around with a cigarette in my mouth and risk lung cancer. Inductive or Deductive: When trying to find if an essay is logically stated, you first must find if it is inductive or deductive. This is an example of an inductive essay. What inductive means is that the author goes from using specific samples to generalizations that are drawn from those examples (McFadden). Major Claim: The major claim is usually the topic sentence or main idea in the article (McFadden). Through the major claim, Peter points out that smoking has beneficial factors. He states those who smoke are less likely to get many diseases such as Parkinson’s disease, Alzheimer’s, endometrial cancer, prostate cancer, osteoarthritis, and colon cancer (Brimelow 142). Another example used in this essay is the author’s comparison of driving automobiles to smoking cigarettes. Brimelow states, â€Å"But so is driving automobiles dangerous to your health (over 40,000 deaths a year)† (141). This to me just seems like a completely ridiculous comparison to include in this article, especially when in the prior paragraph he states that there are approximately 400,000 deaths annually, which are smoking-related (Brimelow). Minor Claim: One minor claim pointed out through this essay is how smoking helps to relax people, which is one form of a stress reliever (Brimelow). In addition, smoking is said to stimulate alertness, dexterity, and cognitive capacity (Brimelow). It is true these are all things in which people can benefit from; however, these are far from being favorable enough for people to decide to go light up. Grounds: Grounds include all evidence, facts, and logic used in supporting claims (McFadden).

Review the Sexual Harassment Tutorial found in the lecture. After viewing the Sexual Harassment Tutorial, completing the reading, and reviewing the lecture notes in conjunction with the TCO, answer the following questions about the tutorial scenario and facts. You’re Role/Assignment: 1. Based upon the scenario, does the employee have a legally viable claim for quid pro quo sexual harassment and/or hostile environment sexual harassment? What is the likely outcome? Based on Robert’s behavior and comments, Brittany was experiencing a hostile environment sexual harassment. Robert is a co-worker whose behavior is unwelcome and inappropriate; therefore creating a workplace that is intimidating, hostile, and/or offensive. His behavior was due to Brittany’s gender and physical attributes. She often witnessed him staring at the photo of her in her bathing suit and making lewd comments regarding her body. She requested he stop making comments because it made her uncomfortable. Shortly after, she found that he scanned the photo to his computer. Upon confronting him again, Robert went to her supervisor complaining that she was not informing him of his messages in a timely manner, which was not true. After notifying Dwayne, her supervisor, of the problems she was having with Robert, Brittany experienced quid pro quo from Dwayne. Dwayne informed Brittany she was traveling with him; she never was required to travel before. She stated she would prefer not to travel; but was told the travel was work related and they would be sharing the same room. He proceeded by telling her that he could promote her if she was willing to show him her amazing breasts while they were on travel. Brittany has a legitimate claim for both work environment sexual harassment and quid pro quo. Upon completion of a thorough investigation, disciplining or firing both Robert and Dwayne should be the first course of action. Additionally, the organization is accountable for the actions of their managers and should monetarily compensate Brittany. 2. Analyze the legal factors for the potential claim(s) in the context of the employee pursuing legal action against the employer. The Supreme Court (Harris v Forklift) concluded that a hostile or abusive work environment can be determined only by looking at all the circumstances. According to established guidance, some factors could be part of the â€Å"circumstances† in a case. They include frequency of discriminatory conduct; severity of the conduct; whether it is physically threatening or humiliating or merely offensive utterance; and whether it unreasonably interferes with an employee’s work performance. Brittany often witnessed Robert staring at the bikini photo and he actually took the photo to scan and make his computer screensaver (frequency and severity). Although Robert’s conduct was not necessarily physically threatening, it was humiliating and offensive. After voicing her displeasure, Robert informed Brittany’s supervisor that she was not performing her duties in a timely manner. This upset Brittany therefore causing several missed workdays (work interference). These actions are clear violations of a hostile environment sexual harassment. EEOC determines sexual harassment to be unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. In quid pro quo cases, an offense occurs if it pertains to conditions of the employee’s employment or institutes the foundation for employment decisions affecting the employee. Dwayne was in violation of quid pro quo rules by requesting Brittany to show him her amazing breasts in exchange for a promotion and move to a different division (basis for employment decisions). Upon declining his request, Brittany received a demotion to the mailroom and a reduction in pay. 3. Let’s shift gears. Using the same scenario, assume you are in the HR department of your organization and you were just presented with the scenario as an example used to explore policies and procedures that will avoid sexual harassment liability. Your boss has asked you to make preliminary suggestions (which will be presented to the legal counsel) regarding sexual harassment protocol that will avoid potential liability. What would your top five suggestions be and why? The first suggestion would be for the organization to implement a clear and explicit sexual harassment policy. This information should be included in the employee handbook provided to everyone during their hire orientation. This will ensure everyone receives initial guidance concerning this sensitive issue as soon as they begin their employment with the organization. Everyone must understand that sexual harassment in the workplace is not acceptable and the company has a zero tolerance for such behavior. The second suggestion is to provide mandatory, separate training to employees and managers/supervisors. Conducting this training will serve as a refresher to everyone to ensure they understand what is and is not considered sexual harassment and also what actions to take if they wish to file a complaint. For managers/supervisors, the annual training should consist of how to ensure they understand sexual harassment and how to deal with complaints. The next suggestion would be to ensure sexual harassment claims receive serious consideration by all parties involved in the reporting processing. The employee should be comforted, not told to â€Å"get over it†. Employees deserve the commitment and due diligence of their organization in handling sensitive matters. Another suggestion would be for the organization to create a zero tolerance atmosphere for sexual harassment. This requires challenging employees immediately when they participate in activities that create an unacceptable workplace. Jokes, sneers, leers, teasing, and gestures are not acceptable. Last, the organization must thrive to keep the workplace friendly and open. This will instill a more pleasant and respectful atmosphere.

The con of the JIT relationship is that problems would occur if the company has sudden breaks to service and the supply. This may lead to labor strikes, and then eventually a failed business. A pro of the JIT relationship would be saving cost by not having unnecessary inventories. Also another attribute is flexibility, allowing the company to answer. †¢Analyze the short-term and long-term consequences that could come from implementing this JIT relationship. The short-term consequence of implementing JIT would be the cost that ties into the culture evolving, training staff on problem solving. The long-term consequence of JIT is improving the quality of the product along with the delivery of it.
